The Arizona Advocacy Foundation for Victims of DCS Corruption is a non profit corporation formed in 2021 to address the corruption that exists at the Arizona Department of Child Safety.


This organization was formed by a retired behavioral health provider with 30 years experience working with children, adolescents, and parents in the behavioral health industry in Arizona. As a parent, our foundation's president has personal experience with issues affecting families, parents rights, and childhood mental illness on a range of topics. The founder of this organization has been involved in all aspects of DCS involving placement and dependency, and has seen and experienced the institutional corruption first hand.

There is nothing more important in society than the protection our children and the vulnerable.


The Arizona Department of Child Safety has been, and will continue to be, the front line guardian and protector of children in the community. We need this department to do it's mission, and expand it's scope, to find abuse and neglect of children and take them out of harms way.


We are in a war against evil that is being waged against our children on a daily basis, and DCS and their army of dedicated case workers are God's warriors leading the battle against the lawless ones who harm, maim, and destroy our children's lives and future's


This is a call to arms for the Governor of the State of Arizona, the Director of the Arizona Department of Child Safety, and the Juvenile Court system. End the corruption right now! End the corruption so we can refocus our efforts in support of the important mission at DCS.


You all know it exists.


We only see what's reported on the news....children taken from their parents for two years with no basis to justify agency removal, an 18 year old boy who reported a case manger who was his foster parent had sexually abused him throughout his childhood, video recordings on the internet as evidence of violations of due process rights of parents in dependency actions, case managers charged with obstruction of justice for falsifying records and reports, employees who left the Arizona Department of Child Safety due to the wanton and unfettered corruption....the list goes on and on. And what of your elected officials who oversees these activities? 


They all know and yet do nothing about the corruption, but pay out civil settlements we hear so often in the news. Their response is to pay out judgments for agency misconduct, sever parents rights who do have causes of action for departmental misconduct, and suppress the reports on the internet with brand and reputation management, hiding their institutional corruption from the public eye by burying their misdeeds in the internet search results.


Those days are over.


The founder of the Arizona Advocacy Foundation for the Victims of DCS Corruption is a reputation management specialist and a CEO of a brand management company. All the reports and complaints of corruption hidden by paid reputation management companies...all those posts will be brought back to the first page internet search results for the community to see. 

Corruption has infultrated all aspects of our society!

This organization's founder comes from a family of law enforcement and fire fighters. The duty to serve and protect has been instilled in his psyche from birth, and is reflected in his years of service to families impacted by violence and abuse in Arizona.


Unfortunately, our society in not the Norman Rockwellian world our forefathers built. We live in a culture were bad people do horrible things to innocent people, violating their duty to protect and serve in their positions of trust and power.


Decent men murdered on camera with knees on their throats by law enforcement; children put in cages and separated from their parents, only to be sexually abused at the border by employees responsible for their care; women being raped and assaulted by their employers, and their only crime was showing up for work to support their families.  Our society has the birth pains of gross moral bankruptcy.


These bad elements have infiltratated the ranks of case mangers and supervisors at the Arizona Department of Child Safety, they have abused their power and authority with heinous acts of cruelty in violating parent's rights with improper separations of children from families with unwarranted dependency actions, and are sadistic characters not fit to hold the honorable positions they have been granted to protect our community's children.

The corrupt hide behind ARS "Secret Courts"

Parents rights are being subjugated and subverted by DCS case managers, the juvenile court, and the Assistant Attorney General's office through Arizona Statute, barring parties from disclosing what goes on in the proceedings in dependency cases involving minor children.


The intent behind these statutes was to protect the identity and the psychological welfare of the children who are the subject of these dependency actions, and for other obvious reasons regarding child welfare and privacy.


The intent of these statutes WAS NOT to protect state employees from acts of gross misconduct and corruption. These statutes have been perverted by the state to intimidate parents from disclosing criminal and ethical violations by DCS employees and the state during dependency actions. These statutes were not enacted to create "secret courts" where American rights and liberties can be violated without public review and disclosure.


The days of DCS secret courts are over. 


The Arizona Advocacy Foundation for Victims of DCS Corruption will publish any complaints made to our organization online and for community peer review, of any acts of wanton corruption by the employees of the Arizona Department of Child Safety in any illegitimate removal or dependency, where the parents rights of due process have been violated, and where evidence exists of any malicious prosecution by the State of Arizona, in attempts to tortuously violate a parents rights to associate with their own children.

Lobbying & Community Activism

The Arizona Advocacy Foundation for Victims of DCS Corruption is a political action organization demanding immediate change to safeguard parent rights and to protect the family from acts of institutional corruption in the most precious right we have as Arizonans and Americans...the right to have and associate with one's own children.


President Barak Obama once stated that the Federal Government is like a barge, and it moves slowly to change course and direction. These are our children and we cannot wait for change. Federal funds go to parents, not to the State of Arizona or DCS employees

There are many reasons for the level of institutional corruption in dependency actions within the Arizona Department of Child Safety and the Juvenile Court. 


Federal funds are allocated to states for adoptions to foster parents of children in dependency. Many states monetize the process by giving "bonuses" to child protective workers who place children under state care into adoption. The states profit, the case workers profit, and this monetization of the dependency process fuels the corruption running rampant in agencies... agencies originally designed to build up families and protect children's welfare interests...their basic human rights to associate with their own parents without the intrusions of government interference into their own families. These government violations into the family attack one of the most fundamental rights we have guaranteed under the United States Constitution....the pursuit of happiness.


Those days are over.


The Arizona Advocacy Foundation for Victims of DCS Corruption demands the demonetization of adoptions out of foster care and that the Arizona Department of Child Safety operates of funds collected from taxes collected locally, and not on federal funds that rewards the adoption of children from state care. These are our children, we can pay for their protection and services ourselves.


We demand any and all federal funds received go directly to parents for services supporting reunification of the family, and when adoption occurs, those federal funds go to the parents and families of the adopted. No more federal funds are to be received, used, or consumed by the state of Arizona, the Arizona Department of Child Safety, or employees at DCS.

We support no political parties or religious orientations

The Arizona Advocacy Foundation for Victims of DCS Corruption is a non political organization fighting for change to end institutional corruption in the dependency process at The Arizona Department of Child Safety, the Juvenile Court of Arizona, and at the Assistant Attorney General's Office.


We support and will campaign for any political candidate, regardless of political party, who supports our demands for change.

We support the involvement of religious and non religious groups in our endeavors for change and will work with all religious entities who endorse our demands to end corruption in the wrongful and tortious removal of children from the loving care of their own parents without just cause.

Arizona Department of Child Safety that is a social services government agency assisting families in the protection of children and interventions to strentheng the family unit through parenting assistance.

The present Director of Arizona Department of Child Safety was elevated to that postion with no experience or background in child welfare delivery or family services in the United States.

The website for DCS boasts this wholly unqualified government official coming to Arizona Department of Child Safety with 15 years aerospace experience:


"Mike found working in child welfare to be extraordinarily rewarding. He officially joined the Child Safety team in December 2016 as Deputy Director where he continued to support strategic planning, projects and management system definition across state agencies."


"Before joining the state, Mike spent over 15 years in the aerospace manufacturing industry in various capacities including general management, value stream management, manufacturing engineering and continuous improvement. Mike's hands-on approach and ability to practically apply lean manufacturing concepts to human services delivery has made a lasting impact on Arizona's child welfare system. Key contributions include the elimination of the 16,000 inactive case backlog, safe reduction of Arizona's out-of-home care population by 25 percent, integration of behavioral and physical healthcare for children in care, increased financial supports for kinship, and replacement of the child welfare data management system."

ABOUT THE AUTHOR OF THIS WEBSITE


Michael Robertson has worked in the behavioral health field with at risk child and adolescent populations at Arizona Baptist Children's Services, as a program supervisor at Community Psychology & Educational Services, and through the health care registry as a psychiatric technician at the Maricopa County Psychiatric Annex in Phoenix, Arizona, in the 1990s and 2000s.


His graduation research project was "Accelerating Children's Cognitive Development" which was also the basis of the Master's thesis he pursued. 


Michael pursued that subject matter as three of his four children had severe cognitive delay, developmental disabilities and language arrest, coupled with intellectual giftedness after their father's psychological interventions, in the areas of qualitative and quantitative reasoning. 

Michael Robertson's life work was devoted to developing the intellectual capacities in his children.

This is Robert and Kathleen Raskin of Las Vegas, and once again we are angered and saddened to report that another child has been ripped from a loving family only to suffer permanent injuries in foster care, thanks to the agency that was supposed to protect her. When a neighbor heard three-year-old Devani’s parents fighting, they called the authorities. Devani was not present at the time, and despite the fact no abuse of the child was observed, proven, or even alleged, Arizona’s DCS removed her from her parents’ care and placed her into not one, but two, horrific situations, one of which will leave the girl badly scarred for life.

In Arizona, the Ombudsman's job is to investigate all government agencies within the state, not only concerns about the Department of Child Safety (DCS). The Arizona Ombudsman office requires you attempt to solve any concerns/problems you have with DCS first, but if you don't have success, contact their office for assistance. 


Arizona DCS recommends you try these steps before reaching out to the Ombudsman:


  • Call your case manager and/or their manager if you have not been responded to after a couple of tries
  • Read what agencies send you and be mindful of directions and deadlines
  • Ask to elevate if the lower-level workers do not understand you
  • Keep all documents, letters, emails, etc that have to do with your concern!
  • File a written complaint -- this will result in a better reaction and potential results, as well as allows you to provide evidence to your claim

The Attorney General's Office shall represent the Department in all contested hearings that affect DCS cases.


DCS Specialists shall attend all hearings affecting their cases and submit reports to the court within the required time frames. For termination of parental rights hearings tried before a jury, the DCS Specialist or DCS Program Supervisor must be present throughout the trial.

Complaint Process

The professional licensing board has the authority to license and regulate the professionals under its jurisdiction. Protection of the public is the boards' primary responsibility. Complaints are a method of informing the board about a professional's action. A uniform complaint procedure assures consistency in processing complaints. It also assures confidentiality, efficiency and accountability.

    Complaints can be filed in one of the following ways:

  • Persons may file a complaint online at: https://amanda-portal.idph.state.ia.us/ibpl/portal/#/dashboards/index. Click on "General Public", then on "File a Complaint", or
  • Persons wishing to file a complaint can open the Complaint form below, enter information into the highlighted fields, print the form, sign and mail to the licensure office, or
  • Persons calling in with a specific complaint will be asked if they wish to file a written complaint. If the person chooses to file a complaint, a complaint form and pre-addressed envelope stamped "confidential" will be mailed to them. The office accepts only written complaints.

Upon receipt of the complaint in the board office, the Bureau Chief opens the envelope, reviews, prioritizes the complaint and gives it to an administrative assistant. The administrative assistant will send a letter to the complainant acknowledging that the complaint has been received and that it has been given to the board for action. The letter states that another letter will follow regarding the board's decision.

All complaints received are acted on. All staff are bound by confidentiality.

How a Complaint is Processed

Anyone may file a complaint against a licensee by filling out the complaint form found here. Complete the form with as much detail as necessary.

The Bureau of Professional Licensure receives complaints for nineteen regulatory boards. It is important to understand the investigation of a complaint is a lengthy process and in some cases may take up to a year.

Under Iowa law board members are not allowed to discuss the complaint with anyone. If you have questions it is best to contact the board administrator for direction.

All complaints received in the office are given a case number and are treated as confidential even to the person complaining and the licensee.

A letter of receipt is mailed to the person filing the complaint.

All complaints needing investigation are referred to the Department of Inspections and Appeals. The Department of Inspections and Appeals completes an investigative report for review and evaluation by the appropriate board.

After reviewing the investigation, the Board may decide to:

  • Close the case;
  • Close the case by writing a confidential letter of education to the licensee;
  • Make a probable cause determination and proceed to a Statement of Charges against the licensee.

Statement of Charges are available to the public upon request. Prior to the Statement of Charges the Board can not acknowledge that a complaint has been filed. A formal hearing before the Board of Examiners or settlement agreement follows the statement of charges. The Board issues a decision following the hearing. Decisions and settlement agreements are available to the public upon request.

Will the licensee know I have filed a complaint against them?

The complaint is confidential after it is received in our office. No one will receive information regarding it. The licensee is interviewed during the investigation. The questioning may lead the licensee to determine who filed the complaint.


Will I have to testify against the licensee?

If the Board determines that there is probable cause for violation of board code or administrative rules you maybe asked to testify at the formal hearing.


Why does it take so long for my complaint to be investigated?

It is important to do a thorough investigation this often involves interviewing numbers of persons and obtaining documents. Two investigators conduct the investigations for the boards. They work as fast as possible to complete the cases.

About this resource

An ombudsman is a person whose job is to work out problems between people and government. The Tennessee Commission on Children and Youth’s (TCCY) Ombudsman Program is an external, third-party problem resolution mechanism for children in the custody of the Department of Children’s Services (DCS), Child Protective Services (CPS), kinship care/relative caregiver program, and DCS foster parent issues. TCCY has statutory authority to review children in the foster care system, kinship care or CPS and make recommendations for improvement. TCCY is an independent state agency that works closely with DCS but is not a part of department. The Ombudsman Program has a mandate to investigate or conduct case file reviews but does not have an enforcement power. Most public sector or government ombudsman offices function in this manner and have the same program limitation. If necessary, written and/or verbal recommendations are provided. Transparency, fairness, accountability, timeliness and best practice are features safeguarded by the Ombudsman Program. The TCCY ombudsman takes referrals from children, families, legislators, national organizations, child advocates, attorneys, school personnel, juvenile courts, DCS workers, service providers and other stakeholders or concerned individuals. The ombudsman can access records and interview children, families and state and private agency staff, in order to help resolve problems. Established in 1996, the TCCY Ombudsman Program adheres to United States Ombudsman Association standards, including a credible review process, confidentiality, impartiality and independence. The ombudsman helps to address problems through a mediation approach focusing on issues, concerns or complaints of individuals. The Ombudsman may serve as an advocate for the family, the state, or the provider when appropriate, but is always working for the child's best interests.  How do I file a complaint against DCS in Arizona?


Working within the Governor's Advocacy Office, the Office of the Foster Care Ombuds is an independent resource to investigate complaints, concerns or violation of rights for children in the custody of Oregon Department of Human Services. The Ombuds position was created in 2013 with the passage of Senate Bill 123. This position is the result of legislation developed and passed by current and former foster youth. The Ombuds  receives, investigates and helps resolve complaints and concerns from a wide range of people including foster youth, parents, relatives, CASAs, attorneys, social workers and many other interested parties.

If you are a current or former foster youth, or if you have concerns or complaints about a child or youth in foster care, the staff at the Ombuds Office will:


  1. Listen to your concerns;

  3. Gather all relevant information;

What is an Ombudsman?

The word “Ombudsman” is derived from the Swedish word meaning “agent” or “representative.”  Ombudsman offices have been established in a variety of state, municipal, county, local, and federal governments, as well in academic organizations and businesses as an independent and impartial organization which assists in obtaining resolution of conflicts or complaints.  Ombudsman may be  alternatively known as "advocate," "citizen's representative," and "mediator."


 The United States Ombudsman Association (USOA), defines the public sector ombudsmen as "an independent, impartial public official with authority and responsibility to receive, investigate or informally address complaints about government actions, and, when appropriate, make findings and recommendations, and publish reports."


The USOA has established a set of best practices guidelines for Ombudsman offices: (1) An Ombudsman office should be independent-free from outside control or influence; (2)  An Ombudsman should be impartial- receive and review each complaint in an objective and fair manner, free from bias, and treat all parties without favor or prejudice. (3)The Ombudsman should control confidentiality- have the privilege and discretion to keep confidential or release any information related to a complaint or investigation; and (4) The Ombudsman should create a credible review process of complaints- perform his or her responsibilities in a manner that engenders respect and confidence and be accessible to all potential complainants. 


Children’s Ombudsman Offices /Office of the Child Advocate


Children’s Ombudsman Offices, also known in some jurisdictions as Office of the Child Advocate, have been established at the state level in order to assist in providing oversight of children’s services.  Currently, approximately twenty-three states have established a Children’s Ombudsman/ Office of the Child Advocate with duties and purposes specifically related to children’s services.  Another five states have a statewide Ombudsman program that addresses the concerns of all governmental agencies, including children’s services.  Nine states have related Ombudsman services, program-specific services, or county-run programs. 


The purpose, responsibilities and duties of the Children’s Ombudsman Office vary by state.  In general, these offices exist to:

  • Handle and investigate complaints from citizens and families related to government services for children and families - this may include child protective services, foster care, adoption and juvenile justice services.
  • Provide a system accountability mechanism by recommending system-wide improvements to benefit children and families - often in the form of annual reports to the Legislature, Governor and public. 
  • Protect the interests and rights of children and families - both individually and system-wide.
  • Monitor programs, placements and departments responsible for providing children's services - which may include inspecting state facilities and institutions.


Complaint Process

Once a concerned party calls a Children’s Ombudsman’s Office with a complaint, the call is screened to determine what action is necessary.  One option is to provide the caller with resources and referrals.  The other option is to open a case.  Once a case is open, the Ombudsman gives notice of the complaint to the agency and begins to investigate or review the complaint and the agency is requested to respond.  If necessary, the Ombudsman may intervene by facilitating communication, holding a meeting, or pursuing legal action.  Once the Ombudsman has concluded its investigation, the office will develop a report while giving the agency the opportunity to respond.  On an annual basis, the Ombudsman will summarize citizen complaints and identify system trends in an annual report.   


Types of Children’s Ombudsman Offices/ Offices of the Child Advocate

Jurisdiction, size and operation of Children’s Ombudsman Offices vary by state. A Children’s Ombudsman Office may be established by legislation, executive order, or by the child welfare agency. A Children’s Ombudsman office can be an independent agency established by statute, existing either in the legislative branch or executive branch, or may be established within the child welfare agency. The office may be run by the government, or a non-profit organization under government contract. This section explains generally how states have organized Children’s Ombudsman Offices. Pursuant to C.R.S. 19-3.3-103(III)(3), the Child Protection Ombudsman, employees of the CPO and any persons acting on behalf of the CPO shall comply with all state and federal confidentiality laws that govern the state department or a county department with respect to the treatment of confidential information or records and the disclosure of such information to the treatment of confidential information or records and the disclosure of such information and records. These laws include, but are not limited to, the Colorado Children’s Code, CAPTA, HIPPA and FERPA.

Child Protective Services (CPS) is a specific social service provided by DHS to assist children believed to be neglected or abused by parents or other adults having permanent or temporary care or custody, or parental responsibility. The program also offers service to household or family members who may require intervention to decrease the risk of any continuing physical, sexual or mental abuse or neglect. The first priority of CPS is to safely maintain a child in their home and to protect the child from further harm and maltreatment.  The Department of Child Safety (DCS) and the State of Arizona Ombudsman-Citizens’ Aide Office

Various statutes in the Arizona Revised Statutes Titles 8 and 41, require the Department of Child Safety (DCS) to permit the State of Arizona Ombudsman-Citizens’ Aide Office unrestricted access to all DCS records, with few exceptions.  Since the State of Arizona Ombudsman-Citizens’ Aide office is not part of DCS, but an independent office of the Arizona Legislature, DCS does not have authority over our office.  This statutory requirement helps to ensure transparency of DCS, and fairness for individuals involved in the DCS process.

In October of 2014, a parent complained to Arizona Ombudsman Citizen’s Aide that their child had been interviewed by a DCS worker while at school without parental consent. According to the state law, “a DCS worker cannot interview a child without parental consent for cases of neglect that do not involve abuse or abandonment.”  The complaint triggered an investigation and the Ombudsman concluded that DCS routinely interviews children in neglect cases, by policy, notwithstanding the legal prohibition against those nonconsensual interviews.

 About this resource

Ombudsman is a Swedish word that means "representative" or "agent." Ombudsman or Child Advocates were established within states and/or Child Welfare to investigate complaints, concerns, or violations of children right's while in foster care.

In Arizona, the Ombudsman's job is to investigate all government agencies within the state, not only concerns about the Department of Child Safety (DCS). The Arizona Ombudsman office requires you attempt to solve any concerns/problems you have with DCS first, but if you don't have success, contact their office for assistance. 

Arizona DCS recommends you try these steps before reaching out to the Ombudsman:

  • Call your case manager and/or their manager if you have not been responded to after a couple of tries
  • Read what agencies send you and be mindful of directions and deadlines
  • Ask to elevate if the lower-level workers do not understand you
  • Keep all documents, letters, emails, etc that have to do with your concern!
  • File a written complaint -- this will result in a better reaction and potential results, as well as allows you to provide evidence to your claim

Authority

The Arizona Office of Ombudsman-Citizens Aide was established on July 1, 1996 as an independent agent of the Arizona Legislature. Statutory authority is found at A.R.S. §§ 41-1371 et seq.

Function

The Ombudsman reviews complaints of citizens who believe they have been treated unfairly by Arizona government. The process of review begins with an evaluation of the complaint and may include one of the following responses: 1) coaching to allow the citizen to resolve the complaint; 2) direct communication by the Ombudsman with the agency involved; or 3) an investigation of the agency’s action. Notice to the agency is required, unless notification would hinder the investigation. The Ombudsman is bound by confidentiality requirements as outlined in statute.

The Ombudsman is also authorized to investigate complaints related to child safety and complaints related to public access laws involving an agency.

History

Background

The Ombudsman was originally established in order to investigate complaints brought by Arizona citizens regarding the administrative actions of state agencies. The responsibilities were expanded in 1998 to include investigations related to Child Protective Services. (Note: In 2014, the division of Child Protective Services in the Arizona Department of Economic Security was replaced by a stand-alone agency, called the Arizona Department of Child Safety. See Laws 2014, Second Special Session, Chapter 1). In 2007, the Ombudsman responsibilities were expanded to include investigation of complaints related to public records and open meeting laws.

Session Laws

Laws 1995, Chapter 281 established the Office of the Ombudsman, effective July 1, 1996, to “investigate citizens’ complaints by investigating administrative acts of state agencies and to issue an annual report to the Governor, Legislature and the public.” Services were available to all Arizona citizens, although the Office was not authorized to investigate complaints filed by a person in the custody of the Arizona Department of Corrections. The measure outlined the selection process and term of office for the Ombudsman; the scope of investigations; confidentiality requirements; procedures; protections; location of the office; and reporting requirements. Patrick Shannahan was appointed as Ombudsman-Citizen Aide by Laws 1996, Chapter 69.

In 1997, the Ombudsman was authorized to appoint an assistant to investigate complaints relating to Child Protective Services. The law provided access to records and the case management system maintained by the Department of Economic Security, Child Protective Services office. Information gathered during the investigation was confidential and was not subject to disclosure. See Laws 1997, Second Special Session, Chapter 3.

Laws 2000, Chapter 47 authorized the Ombudsman to issue subpoenas if necessary and only if a prior request had been made and the person or agency failed to comply within a reasonable time.

Laws 2006, Chapter 370 authorized the appointment of two assistants by the Ombudsman to investigate complaints regarding public access laws involving an agency. The assistants were required to provide training, educational materials and programs to public officials. The measure also required information on the number of requests, inquiries and investigations related to public access laws to be included in the Ombudsman’s annual report.

Laws 2012, Chapter 107 appointed Dennis Wells as the Ombudsman-Citizen Aide to a five-year term, through June 30, 2017. Laws 2017, Chapter 49 continued his appointment to June 30, 2022. Statute requires the appointment of the Ombudsman-Citizen Aide to be proposed as a legislative measure, which must be approved by at least two-thirds of the membership of each chamber of the Legislature.

Laws 2014, Chapter 204 required the Ombudsman to provide the annual report to the Governor’s Office of Strategic Planning and Budgeting, the Joint Legislative Budget Committee and the Administrative Rules Oversight Committee. The distribution was in addition to existing requirements to provide the annual report to various entities, including the Governor, the Legislature and public.

Laws 2014, Second Special Session, Chapter 1 abolished the office of Child Protective Services and transferred its responsibilities and authority to the newly established Department of Child Safety. The measure included conforming changes to Ombudsman statutes.

Laws 2017, Chapter 30 required each state government website to include a link to the Ombudsman-Citizens Aide and a statement regarding the role of the Ombudsman to help citizens resolve issues with state agencies (effective August 1, 2018). The measure also required the Ombudsman’s annual report to describe public awareness and outreach activities.

Laws 2020, Chapter 44 requires the Office to annually, rather than semi-annually, present a report to Legislative Council and allows the Office to appoint one assistant, rather than two assistants.  The measure included a purpose clause and continued the Office for eight years.
